Your privacy is very important to us and we are committed to respecting the privacy of the visitors to all of our sites. We are very careful with what we do with your information.

This Privacy Policy does not apply to any and all information you may provide to us or that we may collect apart from our sites (i.e., any offline means, including but not limited to, mail, telephone, social media, live events, webinars, and during program participation).

Further, by visiting and using any of the above websites, you agree that your use of the site and any dispute over privacy is governed by this Privacy Policy. SECTION 1 – HOW WE COLLECT AND WHAT WE DO WITH YOUR INFORMATION

When you access or purchase something from our store

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address, email address, telephone number and credit card information so that we can process payment to deliver our products or services to you under our contractual obligation.

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system. Our store also may use a standard feature found in browser software called a “cookie” to enhance your experience with the site. We may collect and store personal or other information that you voluntarily supply to us online while you are visiting one of our websites and you “opt in” to receive our newsletters, blogs, emails and promotional communications. Your personal information is stored at the list server that delivers our content and messaging. Your personal information can only be accessed by those who help to obtain, manage or store those lists, or who have a legitimate need to know such personal information in order to deliver e-mail to those who would like to receive our material (i.e., our hosting provider, newsletter provider, payment processors or team members.)

It is important to note that because we are online we may transfer data internationally. For users in the European Union, please be aware that we transfer personal information outside of the European Union. By using our Website and providing us with your personal information, you consent to these transfers in accordance with this Privacy Policy

Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates via our newsletter to you.  You would be affirmatively consenting to this by providing this to us in our contact forms.

We will only collect the minimum amount of information necessary for us to fulfill our obligation to you and may collect:

A name and an email address if you complete our contact form with a question. We may send you marketing emails with either your consent or if we believe we have a legitimate interest to contact you based on your contact or question.

Information from you from a co-branded offer.  In this case, we will make clear as to who is collecting the information and whose privacy policy applies. If both / all parties are retaining the information you provide, this will also be made clear as will links to all privacy policies.

Data Retention

We retain your personal information for the minimum amount of time necessary to provide you with the information and/or services that you requested from us. We may include certain personal information for longer periods of time if necessary for legal, contractual and accounting obligations.

Data Controller and Processors

We are the data controllers as we are collecting and using your personal information.  We use trusted third parties as our data processors for technical and organizational purposes, including for payments and email marketing. We use reasonable efforts to make sure our data processors are GDPR-compliant.

Confidentiality

We aim to keep the personal information that you share with us confidential. Please note that we may disclose such information if required to do so by law or in the good-faith belief that: (1) such action is necessary to protect and defend our rights or property or those of our users or licensees, (2) to act as immediately necessary in order to protect the personal safety or rights of our users or the public, or (3) to investigate or respond to any real or perceived violation of this Privacy Policy or of our Disclaimer, Terms and Conditions, or any other terms of use or agreement with us.

Passwords

To use certain features of the Website or its content, you may need a username and password. You are responsible for maintaining the confidentiality of the username and password, and you are responsible for all activities, whether by you or by others, that occur under your username or password and within your account. We cannot and will not be liable for any loss or damage arising from your failure to protect your username, password or account information. If you share your username or password with others, they may be able to obtain access to your personal information at your own risk.

Security

We take commercially reasonable steps to protect the personal data you provide to us from misuse, disclosure or unauthorized access. We only share your personal data with trusted third parties who use the same level of care in processing your personal data.  That being said, we cannot guarantee that your personal data will always be secure due to technology or security breaches. Should there be a data breach of which we are aware, we will inform you immediately.

Anti-Spam Policy

We have a no spam policy and provide you with the ability to opt-out of our communications by selecting the unsubscribe link at the footer of all e-mails. We have taken the necessary steps to ensure that we are compliant with the CAN-SPAM Act of 2003 by never sending out misleading information. We will not sell, rent or share your email address.

Third Party Websites

We may link to other websites on our Website. We have no responsibility or liability for the content and activities of any other individual, company or entity whose website or materials may be linked to our Website or its content, and thus we cannot be held liable for the privacy of the information on their website or that you voluntarily share with their website. Please review their privacy policies for guidelines as to how they respectively store, use and protect the privacy of your personal data.

How You Can Access, Update or Delete Your Personal Data

You have the right to:

1. Request information about how your personal information is being used and request a copy of what personal information we use.

2. Restrict processing if you think the personal information is not accurate, unlawful, or no longer needed.

3. Rectify or erase personal information and receive confirmation of the rectification or erasure. (You have the “right to be forgotten”).

4. Withdraw your consent at any time to the processing of your personal information.

5. Lodge a complaint with a supervisory authority if you feel we are using your personal information unlawfully.

6. Receive personal information portability and transference to another controller without our hinderance.

Please note that the personal information above that you are giving to us is voluntary and by you providing this information to us you are giving consent for us to use, collect and process this personal information. We only contact individuals who specifically request that we do so or who have signed up to receive our messaging, purchased one of our products or programs, attended one of our programs or events or who have responded to a promotional campaign. The information we use is provided to us by you.

We use the information we collect from you while you are using our sites in a variety of ways, including using the information to customize features; advertising that appear on the sites; and making other offers available to you via email, direct mail or otherwise.

Information we may collect from social networking sites

If you choose to log into our services through Facebook Connect, we will request your permission to collect the following information about you: your e-mail address, name, profile picture, cover photo, friends, gender, networks (e.g., school), age range, language, country, and other information that you have chosen to make public. We may append this information to other information that we collect about you. If you “like” us on Facebook, we also may collect your email address. We may also post to your Facebook wall.

We may also provide your information to trusted third parties, such as our newsletter service provider in order to contact you via email, our merchant account to process payments and Google / social media accounts in order to run social media advertisements and our affiliates and/or create look-alike audiences for advertisements.

Please keep in mind that whenever you voluntarily make your personal information available for viewing by third parties online – for example on message boards, web logs, through email, or in chat areas – that information can be seen, collected and used by others besides us. We cannot be responsible for any unauthorized third-party use of such information that you voluntarily share and make available (i.e., sharing a comment on a blog post, posting in a Facebook group we manage, sharing details on a group coaching call, etc.)

SECTION 2 – THIRD-PARTY SERVICES

We do not sell your personal information to third parties.

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. If you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

Once you leave our store, or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.  The use of any information you may provide in such a case is governed by the privacy policy of the operator of the site you are visiting, or the provider of such products or services. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

Partners

We may make some content, products and services available through our site by emailing messages to you through cooperative relationships with third-party provider partners. We may share with our provider partner any information you provide, or that is collected, in the course of visiting any pages our sites. In comes cases, the provider partner may collect information from you directly, in which cases the privacy policy of our provider partner may apply to the provider partner’s use of your information. If you have any questions regarding the privacy policy of one of our provider partners, you should contact the provider partner directly for more information.

Be aware that we may occasionally release information about our visitors when the release is appropriate to comply with the law or to protect the rights, property or safety of users of the Site or the public.

Google Analytics

We may use third-party service providers, such as Google Analytics Advertiser Features, to evaluate the use of our Website. Such third-party service providers use automated devices and applications to evaluate use of our Websites and services. We or our service providers use these tools to help us improve our Websites, user experiences, and optimize performance. These entities may use cookies and other tracking technologies, such as web beacons or Flash LSO, to perform their services.  Some features include:

By enabling these Google Analytics Display features, we are required to notify our visitors by disclosing the use of these features and that we and third-party vendors use first-party cookies (such as the Google Analytics cookie) or other first-party identifiers, and third-party cookies (such as the DoubleClick cookie) or other third-party identifiers together to gather data about your activities on our Site. Among other uses, this allows us to contact you if you begin to fill out our check-out form but abandon it before completion with an email reminding you to complete your order. The “Remarketing” feature allows us to reach people who previously visited our Site and match the right audience with the right advertising message.

You can opt out of Google’s use of cookies by visiting Google’s ad settings and/or you may opt out of a third-party vendor’s use of cookies by visiting the Network Advertising Initiative opt-out page.

Facebook

As advertisers on Facebook and through our Facebook page, we, (not Facebook) may collect content or information from a Facebook user and such information may be used in the same manner specified in this Privacy Policy. You consent to our collection of such information.

We abide by Facebook’s Data Use Restrictions.

Any ad data collected, received or derived from our Facebook ad (“Facebook advertising data”) is only shared with someone acting on our behalf, such as our service provider. We are responsible for ensuring that our service providers protect any Facebook advertising data or any other information obtained from us, limit our use of all of that information, and keep it confidential and secure.

We do not use Facebook advertising data for any purpose (including retargeting, commingling data across multiple advertisers’ campaigns, or allowing piggybacking or redirecting with tags), except on an aggregate and anonymous basis (unless authorized by Facebook) and only to assess the performance and effectiveness of our Facebook advertising campaigns.

We do not use Facebook advertising data, including the targeting criteria for a Facebook ad, to build, append to, edit, influence, or augment user profiles, including profiles associated with any mobile device identifier or other unique identifier that identifies any particular user, browser, computer or device.

We do not transfer any Facebook advertising data (including anonymous, aggregate, or derived data) to any ad network, ad exchange, data broker or other advertising or monetization related service.

How do I withdraw my consent?

Your information related to visiting our sites is stored at the list server that delivers our content and messaging. Your information can only be accessed by those who help manage those lists in order to deliver email to those who would like to receive it.

All of the messaging or emails that we send to you include an unsubscribe link in them. You can remove yourself at any time from our mailing list by clicking on the unsubscribe link.

SECTION 4 – DISCLOSURE

We may disclose your personal information if we are required by law to do so or if you violate our Terms and Conditions.

Please also note that as our business grows, we may buy or sell various assets. In the unlikely event that we sell some or all of our assets; or one or more of our websites is acquired by another company, information about our users may be among the transferred assets.

SECTION 5 – OUR STORE

Our store is hosted on Infusionsoft by Keap. They provide us with the online e-commerce platform that allows us to sell our products and services to you and take the utmost care in securing data and complying with the GDPR.  See “Data Protection and Privacy at Keap”.

Your data is stored through Infusionsoft by Keap’s data storage, databases and the general Infusionsoft by Keap application. They store your cure server behind a firewall.

Payment/Purchase Transaction Information

If you choose a direct payment gateway to complete your purchase, then Infusionsoft by Keap stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 6 – OUR STORE’S SECURITY

To protect your personal information, our store via Infusionsoft by Keap takes reasonable precautions and follows industry best practices to make sure your information is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with an AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

SECTION 7 – AGE OF CONSENT (CHILDREN’S PRIVACY STATEMENT)

This site is not directed to children under the age of 18 in compliance with COPPA (Children’s Online Privacy Protection Act) and the GDPR (General Data Protection Regulation of the EU). Our Website and its content is directed to individuals who are at least 18 years old or older and we do NOT knowingly collect personally identifiable information from children under the age of 18 as part of any of our sites. We also do NOT knowingly distribute such information to third parties. If we become aware that we have inadvertently received personally identifiable information from a user under the age of 18, we will delete such information from our records. It is not our intention of offer any of our products, programs or services to minors.

SECTION 8 – CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website.
